These Terms & Conditions ("Terms") govern your access to and use of the Jingool mobile application and related websites and services (together, the "Service"). By downloading, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. The Service

Jingool is a curated audio application that provides access to Persian-language audio content, including live radio channels and podcasts, for listeners in the global Iranian diaspora and beyond.

Jingool aggregates and provides access to audio content in two ways: (a) Curated content — we select and provide access to publicly available radio streams and publicly distributed podcast feeds; and (b) Submitted content — channels, producers, and other content providers ("Content Providers") may submit their own streams or feeds to us for inclusion.

Jingool is provided free of charge. We do not require you to create an account or provide personal information to use the Service.

2. Eligibility

You must be at least 16 years old (or the minimum age required to consent to the processing of personal data in your country, if higher) to use the Service.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.

You agree that you will not, and will not permit any third party to:
- copy, modify, distribute, sell, or lease any part of the Service;
- reverse engineer or attempt to extract the source code, except as permitted by law;
- retransmit, rebroadcast, or commercially redistribute any content accessed through it;
- circumvent or interfere with security or access-control features;
- use automated systems (bots or scrapers) to access the Service beyond what a human could reasonably produce;
- use the Service for any unlawful purpose.

4. Content and Third-Party Rights

The audio content made available through the Service — including radio broadcasts, podcasts, music, recordings, names, logos, and artwork — is owned by the respective broadcasters, producers, performers, rights-holders, or Content Providers ("Content Owners"). Jingool does not claim ownership of this third-party content.

Where content is provided by a Content Provider, that Content Provider is responsible for ensuring it has the necessary rights. Where content consists of publicly available streams or feeds that we have curated, we provide access on the basis that such content has been made publicly available by its Content Owners; we respond promptly to valid requests from rights-holders as set out in our Copyright & Takedown Policy.

The Service may stop providing access to any content at any time.

5. Intellectual Property of Jingool

The Jingool name, logo, wordmark, application design, user interface, graphics, and software (excluding third-party content) are the property of Jingool and are protected by intellectual property laws. You may not use any of these without our prior written permission.

6. Submitted Content

If you are a Content Provider and submit content for inclusion, you represent and warrant that you own or have all necessary rights, licenses, and permissions to the content and to authorize its distribution through the Service.

You grant Jingool a non-exclusive, worldwide, royalty-free license to host, stream, and make available the submitted content for as long as it remains listed.

You agree to indemnify Jingool against any claims arising from content you submit that infringes the rights of any third party.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any particular content will remain available.

Live streams and podcast feeds are provided by third parties and may be unavailable, delayed, or modified at any time, outside of our control.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Jingool shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or in connection with your use of (or inability to use) the Service.

Nothing in these Terms excludes or limits liability for matters that may not lawfully be excluded or limited.

9. Changes to the Service and These Terms

We may modify or discontinue the Service at any time. We may also update these Terms from time to time; when we make material changes we will update the "Last updated" date. Your continued use after changes take effect constitutes acceptance of the revised Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
